State migration policy

In order to implement the state policy in the sphere of migration, to improve the legislation in accordance with international norms and current requirements, to ensure national security, stable social-economic and demographic development of the Republic of Azerbaijan in the implementation of laws, to use labour resources rationally, to use intellectual and labour potentials of migrants, to eliminate the negative impacts of irregular migration processes, to prevent illegal migration including human trafficking “The State Migration Program of the Republic of Azerbaijan” (2006-2008) approved by the Order of the President of the Republic of Azerbaijan dated on July 25, 2006.

The main purpose of the State Program is to realize the State policy in the field of migration, to develop the migration management system, to regulate and forecast the migration processes, to improve the legislation in this field in accordance with international norms and current requirements, to ensure the efficiency of the law implementation, to create unit database in the field of migration as well as the modern automated control system, to prevent illegal migration and to undertake measures related to development of international cooperation. The features of migration processes, priority directions of state policy also have been reflected in this Program.

State Migration Service

In order to implement the state policy in the sphere of migration and the authority on management and regulation of migration processes defined with the legislation in the territory of Nakhchivan Autonomous Republic, the State Migration Service of the Nakhchivan Autonomous Republic has been established and its Regulation has been approved by the Decree of the Chairman of the Ali Majlis of Nakhchivan Autonomous Republic dated on May 31, 2010.

The State Migration Service of the Nakhchivan Autonomous Republic follows the Constitutions and laws of the Azerbaijan Republic and Nakhchivan Autonomous Republic, decrees and orders of the President of the Azerbaijan Republic and the Chairman of the Ali Majlis of Nakhchivan Autonomous Republic, resolutions and orders of the Cabinet of Ministers of the Azerbaijan Republic and Nakhchivan Autonomous Republic, international agreements and treaties that the Republic of Azerbaijan supports and its own Regulation. The State Migration Service coordinates with central, local executive and local self-governmental bodies, as well as non-governmental organizations registered in the autonomous republic in the reciprocal connection while implementing its duties and rights. The State Migration Service establishes its activity on regards to human and civil rights and freedom, legality and humanism principles.

The State Migration Service has the following directions of activity:

  • To analyze, forecast migration processes and to organize monitoring;
  • To make decisions on granting permissions on temporally and permanently reside for foreigners and stateless persons;
  • Extension of temporary staying period of foreigners and stateless persons in the Republic of Azerbaijan;
  • Determination of citizenship and refugee status.

At the same time, holding investigations, analysis and inspections on illegal migrants State Migration Service strictly controls issues on deportation of them from the territory of Nakhchivan Autonomous Republic.
